1. The agreement
Kilamile is made by Riv Lux Media Inc ("we"). By using the app you agree to Apple's Licensed Application End User License Agreement and to these terms, which add to it. If the two differ, Apple's agreement applies. How we handle your information is in the Privacy Policy.
2. Not tax advice
Kilamile helps you keep a mileage log, expense records and reports. It doesn't give tax, legal or accounting advice. IRS rates, rules and what counts as a business trip can change and depend on your situation. You're responsible for the accuracy of your records: review your trips, purposes and miles, and ask a qualified tax professional how the rules apply to you. Automatic drive detection can miss a drive or measure it imperfectly, so check your log and correct it when needed.
3. Your safety
Don't use the app while driving. Sort trips after you park, or use Siri. Workouts are your own responsibility: know your limits, follow local laws, and check with a doctor before starting a new exercise routine. Share cards can show where you've been. The Hide start & end option is on by default, and you choose what you share.
4. The business plan
The business plan is called Kilamile Pro in the app. Running and workouts don't require it. Nothing is sold during the beta. These terms apply once it goes on sale, and the app shows the price and length before you buy.
- It's sold as an auto-renewing monthly or yearly subscription through the App Store.
- Payment is charged to your Apple Account when you confirm. The subscription renews automatically, and Apple charges the renewal within 24 hours before the current period ends, unless you turn it off at least 24 hours before that end, in Settings › [your name] › Subscriptions.
- If you cancel, you keep access until the paid period ends.
- If a free trial is offered, the app shows its length, it turns into a paid subscription unless you cancel, and any unused part of it ends when you buy a subscription.
- Refunds are handled by Apple under its policies.
- If the plan ends, you keep all of your records. Only its features stop.
5. Your data
Your records are yours. They're stored on your device and in your own iCloud Drive, not by us, so keeping backups is up to you. Kilamile backs up to iCloud Drive automatically when it's available, and you can save a copy anywhere.
6. Using the app
Use Kilamile only for lawful purposes and in line with these terms. Don't copy, modify, reverse-engineer or resell the app except as the law allows. The Kilamile name, logo and app are ours. Your content is yours.
7. No warranty
The app is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that the app will be error-free, uninterrupted, or that GPS distances, IRS rates or reports will be accurate in every case.
8. Limits of liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential damages, or for lost data, profits, tax deductions or reimbursements, arising from your use of the app. Our total liability for any claim is limited to what you paid for Kilamile in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
9. Governing law
These terms are governed by the law of the State of Wyoming, United States. If you're a consumer in the European Union or another place with its own consumer law, you keep the protections of where you live and can bring a claim there.
10. Changes and contact
We may update these terms. We'll post the new version here with a new date, and continuing to use the app means you accept it.
